The U.S. CICP (Countermeasures Injury Compensation Program) historically had the lowest approval rate among comparable programs — under 5% of COVID-19 claims approved through 2024. A 2026 HHS final rule establishing a formal CICP Injury Table for myocarditis, pericarditis, anaphylaxis, and TTS is expected to materially increase the approval rate for table-eligible claims.
Japan and Taiwan remain notable outliers in recognizing cardiac deaths linked to mRNA vaccines at a higher rate than Western programs. Japan's VIRP has approved over 7,500 claims as of mid-2026 — including hundreds of death-benefit cases — reflecting evidentiary standards and political accountability structures that differ significantly from U.S. and European frameworks.

South Korea's Constitutional Court ruling (2023) remains the only high-court decision to date finding that a government's COVID-19 vaccine injury compensation framework was constitutionally inadequate. The subsequent 2024 legislative expansion of the KDCA program is the first instance of a national legislature directly amending a compensation scheme in response to a constitutional court vaccine injury ruling.
